Terms of Service
Effective Date: January 1st, 2025
These Terms of Service (“Agreement”) govern the use of the photography services provided by Alston Visuals, including but not limited to real estate photography, virtual tours, floor plans, highlight reels, and related services (collectively referred to as the “Services”). By booking or using our services, the client (“Client”) agrees to be bound by these terms.
1. Scope of Services
Alston Visuals provides professional real estate photography services, including but not limited
to:
• Interior and exterior photography
• 360° virtual tours (Zillow, Matterport)
• 2D and 3D floor plans
• Twilight photography
• Branded highlight reels
Additional services or custom requests must be agreed upon in writing, and may be subject to additional fees.
2. Booking & Payment
• Booking: Clients may book services through our website, email, or over the phone. Once the booking is confirmed, a date and time for the photoshoot will be scheduled.
• Payment: Full payment is due upon receipt of the final photos or services provided. Payment can be made by credit card, bank transfer, or other agreed-upon methods.
• Refunds & Cancellations: Refunds are not provided for completed services, but reshoots may be scheduled under certain conditions at the discretion of Alston Visuals.
3. Client Responsibilities
The Client agrees to Property Access: Ensure that the property is accessible at the scheduled time and that any necessary entry instructions are provided to the photographer.
• Preparation: Prepare the property according to the provided Pre-Photoshoot Preparation List to ensure the best quality photos. Any cleaning, staging, or organization of the property is the responsibility of the Client.
• Liability for Property Damage: The Client agrees to hold Alston Visuals harmless for any accidental damage caused to the property during the photoshoot.
• Pets: Pets should be removed or contained during the photoshoot to ensure the safety and comfort of all parties.
• Security & Privacy: The Client is responsible for securing all personal and valuable items before the photoshoot. Alston Visuals is not responsible for any loss or theft during the shoot.
4. Rights and Usage of Photos
• Ownership: Alston Visuals retains ownership of all images and media captured. The Client is granted a limited, non-exclusive license to use the images for marketing and promotional purposes, including MLS listings, websites, print materials, and social media.
• Additional Usage: Any usage beyond the scope outlined (e.g., commercial licensing, distribution, or selling) requires prior written consent from Alston Visuals and may incur additional fees.
• Editing & Reproduction: Alston Visuals retains the right to use photos for portfolio, promotional, and educational purposes unless otherwise agreed upon in writing.
• Storage: Photos and files will be kept for a period of [2 months] after the shoot date. After this period, Alston Visuals is not responsible for retaining or re-delivering photos.
5. Delivery of Services
• Turnaround Time: Photos and media will be delivered within [2] business days after the photoshoot. Virtual tours, floor plans, and highlight reels may take additional time.
• Delivery Method: Final deliverables will be provided via an online gallery, downloadable link, or other agreed-upon methods.
• Reshoots: If the Client is not satisfied with the quality of the final images due to factors like poor lighting, equipment failure, or photographer error, a reshoot may be scheduled at no additional charge.
6. Limitation of Liability
• Quality Assurance: While Alston Visuals strives for the highest quality in all photography services, we do not guarantee that every image will meet the Client's expectations. The final product is subject to subjective interpretation, lighting, weather, and other environmental factors.
• Force Majeure: Alston Visuals will not be held responsible for delays or cancellations due to circumstances beyond our control, including but not limited to weather, accidents, natural disasters, or illness.
• Indemnification: The Client agrees to indemnify and hold harmless Alston Visuals, its employees, agents, and contractors from any claims, damages, or losses arising from the use of the photographs or services.
7. Confidentiality: Alston Visuals agrees to keep any confidential or proprietary information shared by the Client confidential and will not disclose such information to any third party without the Client’s consent, unless required by law.
8. Amendments and Modifications : These Terms of Service may be updated or modified at any time by Alston Visuals. The Client will be notified of any material changes, and continued use of the services after such changes constitutes acceptance of the updated terms.
9. Governing Law: This Agreement will be governed by and construed in accordance with the laws of the state of Georgia, without regard to its conflicts of law principles. Any disputes arising from this Agreement will be resolved in the courts located in Your County/State.
